Because of the judicial components, governance has changed over time according to historical events. The Qajar system, according to its traditional way of governing, was formed on the basis of traditional judicial laws. Laws that were enforced not by written and comprehensive law but by the wishes of the sultan, prince, and local ruler. Punishments, like personal trials, were carried out according to the will of the qibla and different from conventional international law. This research is a descriptive-analytical method and data collection method based on archival documents and library resources. Findings show that the tyranny of Qajar kings, princes, rulers, some of the clergy and their absolute tyranny, lack of legal judicial system, use of inhumane punishments to prevent the recurrence of crime and the example of others, various punishments for personal gain, formed the nature of the Qajar judicial system . Despite various efforts to reform the judicial and legal structure that began during the presidency of Amir Kabir during the reign of Nasser al-Din Shah and was linked to the Constitutional Revolution, the situation continued until the end of the Qajar period with ups and downs.}, keywords = {Punishment,judicial courts,Qajar,reformations}, title_fa = {محاکم قضایی و شیوه مجازات در دوره قاجار}, abstract_fa = {حکومت‌های ایران در تاریخ میانه قوانین ثابت و یکپارچه‌ای برای جامعه قضایی نداشتند. زیرا مؤلفه‌های قضایی حکمرانی در طول زمان با توجه به حوادث و رخدادهای تاریخی متغیر بوده است. نظام قاجار با توجه به شیوه حکمرانی سنتی خود بر بستری از محکمه‌های عرفی و شرعی و مجازات‌های نامشخص شکل گرفته بود. مجازات‌ها و داوری‌هایی که نه از روی قانون مکتوب و فراگیر بلکه بر اساس امیال سلطان، شاهزاده، حاکم و روحانیون محلی اجرایی می‌گردید. این مجازات‌ها نیز مانند محاکمات شخصی بر اساس خواست قبله عالم و با استفاده از شیوه‌های غیرانسانی انجام می‌گرفت. این تحقیق، با روش توصیفی-تحلیلی و با تکیه بر اسناد آرشیوی و منابع کتابخانه‌ای انجام شده است. یافته‌های پژوهش نشان می‌دهد خودکامگی سلاطین، شاهزادگان، حکام قاجاری و برخی از روحانیون و استبداد مطلقه آنان، فقدان نظام قانونمند قضایی، استفاده از مجازات‌های غیرانسانی برای جلوگیری از تکرار جرم و عبرت سایرین، و مجازات‌های گوناگون در جهت اغراض شخصی، ماهیت نظام قضایی دوره قاجار را تشکیل می‌داد. با وجود تلاش‌های گوناگون در مسیر اصلاح ساختار قضایی و قانونی که از دوره صدارت امیرکبیر در عهد ناصرالدین شاه آغاز شد و با انقلاب مشروطه پیوند یافت، تداوم وضع موجود تا پایان دوره قاجار با فراز و فرودهایی همراه بود.}, keywords_fa = {مجازات,محاکم قضایی,قاجار,اصلاحات}, url = {https://journal.asi.org.ir/article_252735.html}, eprint = {https://journal.asi.org.ir/article_252735_adf13afa699b7d044b5b7abf9af08d3c.pdf} }
